Equipment in Transit: Who is Liable for Damage?

Whether you are purchasing a new piece of equipment, returning it at the end of a lease, or selling it to a customer, it is important to determine who will be liable should damage occur in transit.  Accidents can happen on the road as well as while the equipment is being loaded or unloaded. Lifetime Investments in Mesa, AZ knows how a damaged piece of equipment can result in a significant loss to a company if not adequately insured.  

Who is Responsible if a Piece of Equipment is Damaged in Transit?

The responsibility of damage will typically fall on either the company handling the transit or the company that holds to title to the piece of equipment.

Shipping Company

Some shipping will ask for a value of the equipment that you are shipping.  They will include a fee to insure up to the amount you complete on the bill of lading.  If the equipment is damaged while in transit due to traffic accident or theft, the company will cover you up to the amount you are insured.  If the freight company does not include coverage in their price, they will ask you to provide a certificate of coverage.  For companies such as UPS and FedEx, they only include up to $100 of coverage unless you insure it for an additional value for an added expense.

Title Holder

If your freight company does not provide insurance coverage, the cost for damage will fall to the title holder at the time that the piece of equipment becomes damaged.  This should be established before shipping so that the company who owns it can be sure to have proper coverage on it.  

For example, if you are returning a leased piece of equipment and your lease does not end until the equipment is received, the leasing company is the title owner, and you are just the lessee so their insurance would typically cover the piece unless your contract specifies otherwise.  If you sell a piece of equipment and you have accepted payment and transferred the title to the new owner, you will want to make sure that they have coverage in place on it before it is shipped.

Arizona Block Parties (2016)

Block parties!  Arizona communities seem to have a natural affinity for them and it made me wonder just how many rich resources there were out there to:

  1. Find them
  2. Create them
  3. Best manage them
  4. Meet city guidelines for them

The following should add to your summer fun as you make a shift in traveling outside the city to get away from the heat – and find a way to enjoy it – along with others!

I found a nice list of events held in Glendale but the only ‘block party’ type of activity was:  Glitter & Glow Block Party  Saturday, January 7, 2017  4 – 10 p.m.

The Phoenix Mad Decent Block Party seems to be a pretty popular event and is repeating a massive 2-day music festival on Friday, September 16th & Saturday, September 17th at Rawhide! The Phoenix stop for this summer’s biggest EDM tour, is one of only two multi-day MDBP events…so don’t miss out! This show is 18+.

Headlining Artist include: Diplo, Aluna George, FKI IST, Jackal, Tchami, Baauer, Flosstradamus, Justin Martin, Le Young, Lil Dicky and more!

I was pleasantly surprised at the ‘help’ offered by Scottsdale – to encourage block parties through its GAIN program.  If you live in Scottsdale, you really owe it to yourself to take the fullest advantage of using this program to make a big difference in your summer fun!
Getting Arizona Involved in Neighborhoods is an annual event designed to unite neighbors and communities to help create safer neighborhoods. Formerly known as National Night Out, G.A.I.N. encourages residents to get together in their respective communities to promote safety, neighborhood communication and celebrate the successes of crime prevention through community involvement.

ARIZONA Communities love Block Parties!

 It is true, Arizona communities love block parties! I have been really happy to have found so many ideas and resources for those of you who find it just short of impossible to get away this summer. Budgets are tight, schedules are cramped, kids too small or in too many other summer activities. So… why not have a Block Party!

I remember the days my kids were small, it was difficult at best to plan any thing major for summer, but… summer is supposed to be fun. We all get excited about it – especially in Arizona communities where we can have all day swim fests, stay up way past bedtime and sleep in late as we catch up on all the community socializing we miss during a busy school year.

The idea of throwing a block party is one of those things that really is limited only to one’s imagination as neighbors band together, find a “sponsor” for the perfect, affordable summer treat, and plan barbeques and potlucks that can be amazingly created from the barest of cupboards. No need to drag the kids along to shop… no endless hours at a hot stove. Light, cool, and quick are the order of the day as communities make the transition from rigid schedules to summer fun.

There are, of course certain requirements to which we must adhere. I researched and listed below the links to the cities who openly provide Block Party Rules. I trust you will get excited when you see they are not as restrictive as you may have thought!
